Fraxir Terms of Service
 
Please read these Terms of Service ("Terms") carefully before using the Fraxir platform ("Fraxir" or the "Platform"). These Terms govern your access to and use of Fraxir, including any content, features, and services provided by Fraxir. By accessing or using Fraxir, you agree to be bound by these Terms. If you do not agree with these Terms, you may not use Fraxir.

User Responsibilities and Conduct:
a. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.
b. You agree not to use Fraxir for any illegal or unauthorized purpose and to comply with all applicable laws and regulations.
c. You must not harass, threaten, impersonate, or intimidate other users of Fraxir, and you must not interfere with or disrupt the Platform's operation or servers.

User-Generated Content and Curation:
a. Fraxir allows users to create, share, and curate educational modules. By submitting or curating content on Fraxir, you represent and warrant that you have the necessary rights and permissions to do so.
b. You retain ownership of the content you create, but you grant Fraxir a non-exclusive, royalty-free, worldwide license to use, modify, reproduce, and distribute your content for the purposes of operating and promoting Fraxir.
c. You understand that Fraxir does not endorse or guarantee the accuracy, reliability, or quality of user-generated content. You access and use user-generated content at your own risk.

Intellectual Property:
a. Fraxir and its original content, features, and functionality are protected by intellectual property rights, including copyrights, trademarks, and other proprietary rights. You agree not to reproduce, modify, distribute, or create derivative works based on Fraxir or its content without prior written permission from Fraxir.

Advertising and Premium Membership:
a. Fraxir may integrate advertisements within the Platform. You acknowledge and agree that these advertisements are a part of the Platform and that Fraxir may display them to you.
b. Fraxir may offer premium membership features that provide additional benefits to subscribers. The specific terms and conditions of premium membership will be outlined separately, and your use of such features is subject to those terms.

Privacy:
a. Fraxir collects and processes personal data in accordance with its Privacy Policy. By using Fraxir, you consent to the collection, processing, and sharing of your personal data as described in the Privacy Policy.

Termination:
a. Fraxir reserves the right to suspend or terminate your access to the Platform at any time and for any reason, without prior notice or liability.

Limitation of Liability:
a. Fraxir and its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of Fraxir or any content on the Platform.

Modifications to Terms:
a. Fraxir reserves the right to modify or replace these Terms at any time. Updated Terms will be posted on Fraxir, and your continued use of the Platform after any such changes constitutes your acceptance of the modified Terms.

Governing Law and Jurisdiction:
These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region ("Hong Kong SAR"). Any legal action or proceeding arising out of or relating to these Terms or your use of Fraxir shall be exclusively brought in the courts of Hong Kong SAR.
Severability:
a. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Violation of the Terms of Service for Fraxir may result in various consequences, which may include but are not limited to:

Warning: For minor or first-time violations, a warning may be issued to the user, informing them of the violation and reminding them of their obligations under the Terms of Service.

Temporary Suspension: In cases of more severe or repeated violations, Fraxir may temporarily suspend the user's access to the platform for a specified period. During the suspension, the user will be unable to access their account or use Fraxir's services.

Permanent Account Suspension: In cases of severe or repeated violations, Fraxir reserves the right to permanently suspend the user's account. This action would result in the loss of access to the platform and all associated services permanently.

Removal of Content: Fraxir may remove or disable user-generated content that violates the Terms of Service. This may include content that is illegal, infringing, abusive, or otherwise prohibited under the Terms.

Legal Action: In cases where a user's actions violate applicable laws or cause harm to Fraxir or other users, Fraxir may take legal action against the user, seeking remedies and damages as permitted by law.

The specific consequences for violating the Terms of Service will depend on the nature and severity of the violation, and Fraxir reserves the right to exercise its discretion in applying these consequences.
